Article 1 – Definitions

In these terms and conditions, the following definitions apply:

Cooling-off period: the period within which the consumer may exercise their right of withdrawal;
Consumer: the natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with the entrepreneur;
Day: calendar day;
Ongoing transaction: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time;
Durable data carrier: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information;
Right of withdrawal: the option for the consumer to withdraw from the distance contract within the cooling-off period;
Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance;
Distance contract: a contract concluded between the entrepreneur and the consumer within the framework of an organised system for distance sales of products and/or services, whereby exclusive use is made of one or more means of distance communication up to and including the conclusion of the contract;
Means of distance communication: a means that can be used to conclude a contract without the consumer and entrepreneur being simultaneously present in the same location;
Terms & Conditions: the present Terms & Conditions of the entrepreneur.

Article 3 – Applicability

These Terms & Conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.

Before the distance contract is concluded, the text of these Terms & Conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated prior to the conclusion of the distance contract that the Terms & Conditions are available for inspection at the entrepreneur’s premises and will be sent free of charge upon request.

If the distance contract is concluded electronically, the text of these Terms & Conditions may be made available electronically in such a way that it can be easily stored by the consumer on a durable data carrier. If this is not reasonably possible, it will be indicated where the Terms & Conditions can be accessed electronically and that they will be sent free of charge upon request.

If specific product or service conditions apply in addition to these Terms & Conditions, the above provisions apply accordingly, and the consumer may rely on the provision most favourable to them in the event of conflicting conditions.

If one or more provisions of these Terms & Conditions are wholly or partially invalid or voided, the remaining provisions shall remain in force. The invalid provision shall be replaced by a provision that most closely reflects the intent of the original.

Situations not covered by these Terms & Conditions shall be assessed in the spirit of these Terms & Conditions. Any ambiguities regarding interpretation shall likewise be interpreted in the spirit of these Terms & Conditions.


Article 4 – The Offer

If an offer has a limited validity period or is subject to conditions, this will be expressly stated. All offers are non-binding. The entrepreneur reserves the right to amend offers.

The offer includes a complete and accurate description of the products and/or services offered, sufficient for the consumer to properly assess the offer.

Images are a truthful representation of the products offered. Obvious errors or mistakes do not bind the entrepreneur. All images, specifications and information are indicative and do not entitle the consumer to compensation or dissolution of the agreement. Colours shown may differ from actual colours.

Each offer clearly states:

  • the price including taxes;

  • any shipping costs;

  • how the contract is concluded;

  • whether the right of withdrawal applies;

  • payment, delivery and execution methods;

  • the validity period of the offer or price guarantee;

  • any additional communication costs;

  • whether the contract will be archived and how it can be accessed;

  • how the consumer can verify and correct provided data;

  • available languages;

  • applicable codes of conduct;

  • the minimum duration of the contract in case of ongoing transactions.

Optional: available sizes, colours, materials.


Article 5 – The Agreement

The agreement is concluded at the moment the consumer accepts the offer and fulfils the stated conditions. Electronic acceptance is confirmed electronically.

Until confirmation is received, the consumer may dissolve the agreement.

Appropriate security measures are taken for electronic transactions. The entrepreneur may assess the consumer’s ability to meet payment obligations and may refuse or impose conditions if justified.

Upon delivery, the consumer receives:
a. the business address for complaints;
b. instructions regarding the right of withdrawal;
c. warranty and after-sales service information;
d. relevant contract details;
e. termination requirements for long-term contracts.

All agreements are subject to product availability.


Article 6 – Right of Withdrawal

The consumer may withdraw from the purchase within 14 days without stating reasons. This period starts the day after receipt.

Products must be handled with care and returned in original condition where possible. Withdrawal must be communicated in writing or by email within 14 days. The product must then be returned within 14 days. Proof of return is required.

Failure to act within the stated periods results in a binding purchase.


Article 7 – Costs in Case of Withdrawal

Return shipping costs are borne by the consumer. Refunds will be processed within 30 days after withdrawal, provided the product has been received or proof of return supplied.


Article 8 – Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for:

  • customised or personalised products;

  • perishable goods;

  • sealed hygiene products once opened;

  • audio/video recordings or software with broken seals;

  • newspapers and magazines;

  • services already commenced with consent.


Article 9 – Price

Prices remain unchanged during the offer period, except due to VAT changes. Prices include VAT. Obvious pricing errors are not binding.


Article 10 – Conformity and Warranty

Products must meet reasonable quality standards. Manufacturer warranties do not affect statutory rights. Defects must be reported within 14 days.

Warranty does not apply if products are misused, modified, or improperly handled.


Article 11 – Delivery and Execution

Orders are fulfilled with due care and within 30 days unless otherwise agreed. Delays are communicated. Refunds are issued within 14 days in case of cancellation. Risk passes upon delivery.


Article 12 – Ongoing Transactions

Consumers may terminate ongoing contracts with a maximum notice period of one month. Automatic renewals are restricted as specified.


Article 13 – Payment

Payments must be made within 7 working days. Incorrect payment details must be reported immediately. Reasonable collection costs may apply in case of default.


Article 14 – Complaints Procedure

Complaints must be submitted within 7 days. Responses are provided within 14 days. If unresolved, disputes may arise. Valid complaints may result in repair or replacement.


Article 15 – Disputes

All agreements are governed exclusively by Dutch law, even if the consumer resides abroad.
